By using the StrayTats.com affiliate program you agree to be bound by the following terms and conditions.

Term of Affiliate Account

• The term of your affiliate account with StrayTats will begin upon acceptance of your application by StrayTats and end upon termination of the account by either party. Either party may terminate the affiliate account at anytime without prior notice, for any reason. Referral commissions are earned by an affiliate only for sales occurring during the set term.

Commisssions

• As a StrayTats affiliate you will receive a %20 commission on all sales on the StrayTats website, less shipping fees and applicable sales tax, originating from a referral tagged with your StrayTats merchant key for a period of one calendar week from the time of referral.


• Payment will be issued on the 15th of each month for the earnings of the entire previous month.


• Payments will be issued via Paypal and require an email address to properly notify the individual or organization which is to receive said payment.
  
  
  • You are responsible for the proper use and security of your StrayTats affiliate account.
  • StrayTats will not 're-send' payments to improperly logged email addresses if said payment has already been claimed.

Copyrights

• Some of the tattoo designs on the StrayTats.com website are public domain images and free for public use. Other than these, all logos, graphics, photographs and website content contained on the site are copyrighted and trademarked by StrayTats and are protected under intellectual property rights. With the exception of the provided click-though affiliate banner links and any other materials designated specifically for affiliate marketing purposes, no StrayTats intellectual property may be redistributed, republished, or resold in any form.


• You may not use, in your domain name, URL, or in any advertising service such as Google AdWords or Microsoft AdCenter, the terms Xirsix, StrayTats, any variation of these words, or any other intellectual property of our website.

Unacceptable Practices

• StrayTats strives to maintain a positive and healthy public image. We will not have affiliate relationships with websites that have content that promotes, or uses advertising techniques that involve (including AdWords keywords) concepts, ideas, or movements that are deemed at the sole discretion of StrayTats Management to be unethical, immoral, intensely divisive, or otherwise projecting an image with which we do not wish our company to be associated, including but not limited to:
  
  
1. Misrepresenting Our Product or Service
2. Encouraging Criminal Behavior
3. Drug Use
4. Violence
5. Pornography
6. Dealing in or Promoting Fake or Counterfeit Items (Excluding "fake" or otherwise temporary tattoos
7. Hate Groups such as Nazis or the KKK
8. Discrimination
9. Unethical Marketing Practices Such as Spamming
10. Infringing on the Intellectual Property Rights of Others

If you are found to be associated with any of the items listed above or other items of a similarly heinous nature, StrayTats may revoke your affiliate account and withhold or recover any commissions on transactions not in compliance with these Terms and Conditions. You must also immediately remove all association with, and references or links to StrayTats or Xirsix from your website.

Liability

• StrayTats will not be liable for any losses or damages of any kind that may arrise in connection with the affiliate relationship or this agreement.

Spam/Fraud

• StrayTats will immediately revoke the account of any affiliate suspected of or caught spamming, or engaging in fraud or unethical marketing practices.

Amendment

• StrayTats reserves the right to amend or modify these terms and conditions at any time. Affiliates will be notified of changes by email. Continuing the affiliate relationship shall serve as acceptance by the affiliate of the new Terms and Conditions. If the new Terms and Conditions are unacceptable to the affiliate, the affilate's only recourse is to close their account and sever their relationship with StrayTats.

Drop-Ship Program (Optional Enrollment)

• StrayTats.com provides an automated service which allows users to create and produce their own temporary tattoos. We claim no intellectual property rights over the material uploaded to the StrayTats service. By linking images to our website via the Site Integration feature you testify that you are the rightful copyright or trademark owner of said images, or that you have full permission of the copyright/trademark owner to use said images for reproduction and/or resale, or that the images linked to our site are in the public domain or are otherwise free of intellectual property protection. You agree to assume full legal responsibility for the intellectual property status of any image you link to our site, and to absolve StrayTats of any possible liability connected with said images. If you are found to be illegally selling the intellectual property of others StrayTats will terminate your account.
